MORUXO Furnishings, a DBA of Three Travelers LLC

These Terms & Conditions of Sale ("Agreement") apply to all purchases made from Three Travelers LLC DBA MORUXO Furnishings ("MORUXO," "Company," "we," "our," or "us").

By placing an order, submitting payment, or taking possession of any product, the Buyer acknowledges and agrees to the terms outlined below.

1. Products & Natural Materials

MORUXO specializes in handcrafted furniture made from natural wood slabs and other organic materials. Because each piece is made from real wood, every product is inherently unique and will naturally vary in:

• Grain pattern
• Color tone
• Figure and texture
• Width and thickness
• Natural movement
• Cracks, knots, voids, and live edges
• Filled areas and epoxy work
• Surface character and imperfections

No two pieces will ever be identical.

Wood is a natural material that continuously reacts to temperature, humidity, sunlight, usage conditions, and seasonal climate changes. Slight movement, expansion, contraction, checking, or minor cracking may occur over time and are considered natural characteristics of solid wood furniture — not manufacturing defects.

Product photos shown online, social media, catalogs, or in person are representative examples only and may not perfectly reflect the exact appearance of the purchased item.

2. Inventory Items & Modifications

Many MORUXO products are sold from existing inventory slabs selected by the Buyer.

Certain projects may require modifications to inventory items prior to delivery, including but not limited to:

• Electrical grommets
• Wire-management holes
• Standing desk integrations
• Resizing
• Refinishing
• Additional fabrication or customization work

Because these modifications permanently alter the furniture, MORUXO may require full payment prior to fabrication or customization work beginning.

Once modification or fabrication work begins, the sale becomes final and non-refundable.

The Buyer is responsible for confirming all requested specifications, measurements, placement locations, and compatibility requirements before approval is given and fabrication begins.

MORUXO is not responsible for:

• Incorrect measurements provided by the Buyer
• Office layout incompatibility
• Third-party equipment fitment
• Future technology changes
• Preference changes after fabrication begins

3. Payment Terms

Full payment may be required prior to reserving inventory, fabrication, modification work, delivery scheduling, or release of products.

Because certain modifications permanently alter the furniture, MORUXO may require full payment prior to fabrication or customization work beginning.

Accepted payment methods may include:

• Cash
• Check
• ACH / Bank Transfer
• Credit or Debit Card

Credit and debit card payments may be subject to an additional convenience fee of up to 3% of the total transaction amount, including applicable taxes and delivery charges.

All balances must be paid in full prior to delivery or pickup unless otherwise agreed in writing.

Prices, availability, lead times, and specifications are subject to change without notice.

4. Commercial Use

Furniture used in commercial environments — including conference rooms, offices, coworking spaces, hospitality settings, restaurants, and shared workspaces — is subject to substantially heavier and more frequent wear than typical residential furniture.

Conference tables, restaurant/hotel tables, and commercial desks are functional furniture pieces intended for continuous daily use and will naturally develop visible signs of wear over time.

Commercial use may accelerate:

• Surface scratching
• Denting and impressions
• Finish wear
• Edge wear
• Sheen variation
• Cosmetic aging
• Movement of wood

Activities such as dragging laptops, sliding office equipment, writing directly on the surface, repeated cleaning, moving accessories, and constant daily use may cause visible scratches, impressions, sheen changes, and surface wear to appear relatively quickly.

These conditions are considered normal wear and are not manufacturing defects.

5. Finishes & Surface Protection

Unless otherwise stated in writing, MORUXO furniture is typically finished using Rubio Monocoat or similar hardwax oil finishes designed to preserve the natural appearance, texture, and feel of real wood.

Unlike thick commercial polyurethane, epoxy, or synthetic coating systems that primarily create a heavy protective barrier on top of the wood, hardwax oil finishes are primarily intended to seal and protect the wood while maintaining a natural matte appearance and authentic wood feel.

These finishes are intentionally selected for their natural aesthetic and repairability rather than maximum scratch resistance.

As a result, surfaces finished with Rubio Monocoat or similar hardwax oils are not scratch-proof, dent-proof, stain-proof, waterproof, or intended to perform like thick commercial bar-top or industrial coatings.

One of the major advantages of hardwax oil finishes is that they are generally easier to maintain and repair compared to thicker film-building finishes. Minor scratches, wear areas, or damaged sections can often be refreshed or repaired locally without requiring complete refinishing of the entire table or professional restoration services.

For this reason, hardwax oil finishes remain a popular choice for high-end wood flooring, furniture, and natural wood surfaces where maintaining an authentic matte appearance and long-term repairability is preferred over creating a thick synthetic coating.

Customers seeking maximum hardness or heavier commercial-grade coating systems should understand that while alternative finishes may provide increased surface protection, no wood finish is completely scratch-proof, damage-proof, or maintenance-free. All finishes — including polyurethane, conversion varnish, epoxy, lacquer, ceramic coatings, or other commercial systems — will naturally wear, scratch, dent, fade, age, or develop signs of use over time, particularly in commercial environments and high-traffic applications.

Minor cosmetic wear resulting from normal use is not considered a defect.

6. Natural Wood & Living Organisms

MORUXO and its suppliers make reasonable efforts to inspect, dry, treat, seal, and finish natural wood products to reduce the likelihood of insects, organisms, or pests being present within the wood.

However, because real wood is an organic and naturally porous material, MORUXO cannot guarantee that wood products are permanently free from:

• Wood-boring insects
• Beetles
• Larvae
• Termites
• Ants
• Pests
• Fungi
• Mold spores
• Other living organisms

Even after kiln drying, heat treatment, fumigation, sealing, or finishing, there is always a possibility that organisms may exist in dormant form or may later enter or emerge from the wood.

This is an inherent risk associated with purchasing products made from natural wood materials.

By purchasing from MORUXO, Buyer acknowledges and accepts this natural risk and agrees that MORUXO shall not be held liable for:

• Organisms discovered after delivery
• Property damage allegedly related to organisms
• Pest treatment costs
• Fumigation expenses
• Indirect or consequential damages related to insects or organisms

Customers are encouraged to maintain proper environmental conditions and pest-control practices within their home or commercial environment.

7. Table Flatness, Floor Conditions & Leg Alignment

MORUXO furniture is handcrafted using natural materials and metal fabrication components that may contain slight tolerances and variations.

Because natural wood slabs are not manufactured like machine-made synthetic surfaces, minor variations in flatness, leveling, alignment, or balance may occur.

Additionally:

• Floors are often uneven
• Slabs may contain natural movement or slight variation
• Metal legs may contain small manufacturing tolerances
• Large slabs may naturally shift over time due to humidity and environmental conditions

As a result, slight rocking, uneven contact points, small gaps, leveling differences, or alignment variation may occur and are not considered manufacturing defects.

In many cases, these conditions result from a combination of:

• Natural slab variation
• Floor unevenness
• Environmental movement
• Leg fabrication tolerances
• Installation surface conditions

Minor leveling adjustments, shimming, or repositioning may occasionally be necessary after installation.

8. Epoxy & Wood Movement Disclosure

Many MORUXO products contain epoxy-filled cracks, voids, knots, or natural openings.

Because wood naturally expands, contracts, and moves over time, slight separation between the wood and epoxy may occasionally occur.

Natural wood movement may cause:

• Minor epoxy lifting
• Slight separation lines
• Texture variation
• Hairline cracking around filled areas
• Raised or recessed epoxy sections

These conditions are normal characteristics of real wood furniture and are not considered manufacturing defects.

MORUXO does not guarantee permanent stability between natural wood movement and epoxy-filled areas.

Because epoxy work is partially handcrafted and influenced by environmental conditions, curing behavior, pigment movement, lighting, slab absorption, temperature, humidity, and pouring techniques, minor cosmetic imperfections may naturally occur within epoxy-filled areas.

These may include, but are not limited to:

• Slight color variation between pours
• Pigment inconsistency
• Small air bubbles
• Minor surface waviness
• Hairline cracking
• Texture variation
• Slight unevenness
• Natural separation lines
• Minor imperfections within filled areas

These characteristics are considered normal within handcrafted epoxy and natural wood furniture and are not considered manufacturing defects.

Buyer acknowledges that epoxy-filled areas are accepted AS-IS upon delivery or pickup. MORUXO shall not be responsible for cosmetic epoxy characteristics or imperfections discovered after the product enters the Buyer's possession that were visible or reasonably observable at the time of delivery, pickup, or inspection.

9. Electronics & Standing Desk Components

Certain products may include third-party electronics or hardware components such as:

• Standing desk frames
• Motors
• Control panels
• USB outlets
• Power modules
• Wire management systems
• Integrated lighting
• Electrical accessories

These components are manufactured by third parties and are not produced by MORUXO.

MORUXO does not guarantee:

• Lifespan of electronic components
• Future compatibility
• Future replacement availability
• Continuous manufacturer support
• Protection from power surges or misuse

MORUXO shall not be liable for:

• Motor failures
• Electrical malfunctions
• Wiring failures
• Electronic defects
• Compatibility issues
• Software or controller issues
• Damage caused by misuse, overloading, improper installation, commercial wear, or external electrical conditions

Any applicable manufacturer warranty must be handled directly through the original manufacturer or supplier. MORUXO may provide manufacturer references or purchase links when available as a courtesy.

10. Delivery, Moving & Assembly Disclaimer

As a courtesy to customers, MORUXO may assist with the delivery, transportation, moving, placement, or assembly of furniture products either directly or through third parties. Any fees charged for these services are intended to offset labor, transportation, coordination, and handling costs and do not constitute acceptance of liability for the property or installation environment. Customer responsible for verifying elevators/door clearances/access. If furniture products cannot fit through clearances the delivery/assembly will still be charged to the customer.

Buyer acknowledges that large wood furniture pieces are extremely heavy and may require maneuvering through tight spaces, stairways, elevators, doorways, or finished surfaces.

MORUXO shall not be responsible for:

• Damage to walls
• Damage to floors
• Scratches or dents
• Property damage
• Tight-fit installations
• Building access limitations
• Elevator or stairwell restrictions
• Damage caused during moving or assembly
• Damage caused by third-party movers or installers

Once delivery or assembly services begin, Buyer assumes all risks associated with placement and installation conditions.

Minor adjustments, leveling, repositioning, or future maintenance may be required after installation due to floor conditions, natural wood movement, or environmental changes.

Buyer is responsible for ensuring that all doorways, hallways, stairways, elevators, and installation locations are adequate for the furniture dimensions before delivery. Failed deliveries or additional delivery attempts resulting from access limitations may result in additional charges.

10A. Freight Shipments & Shipping Claims

When MORUXO arranges or assists with shipping through a common carrier, freight company, blanket-wrap carrier, independent transporter, delivery service, or other third-party transportation provider, MORUXO does so as a convenience to the Buyer. Unless MORUXO expressly agrees otherwise in writing, the transportation provider is an independent third party and is not an employee, agent, or representative of MORUXO.

Risk of Loss During Shipment

Unless MORUXO expressly agrees otherwise in writing, all shipments originating from MORUXO's facility in Texas are shipment contracts and not destination contracts. Risk of loss or damage during transportation passes to the Buyer when the product is duly tendered and released to the third-party carrier at the place of shipment, to the maximum extent permitted by applicable law.

This provision applies regardless of whether the shipping destination is located within Texas or another state and regardless of whether MORUXO arranges, schedules, coordinates, or collects payment for transportation on the Buyer's behalf.

MORUXO is not responsible for loss, theft, delay, mishandling, impact damage, water damage, packaging damage, or other damage occurring after the product has been released to a third-party carrier, except to the extent directly caused by MORUXO's own acts or omissions before release to the carrier.

Payment of freight charges to MORUXO, or MORUXO's coordination, scheduling, or selection of a carrier, does not make MORUXO the carrier and does not constitute an assumption by MORUXO of the carrier's transportation liability.

Nothing in this provision limits Buyer's rights arising from MORUXO's delivery of goods that were nonconforming prior to release to the carrier or any rights that cannot lawfully be waived or limited.

Condition Before Shipment

MORUXO may photograph or video the furniture, packaging, crate, wrapping, loading process, or condition of the product before or at the time it is released to the carrier. Such photographs, videos, shipping documents, or other records may be used as evidence of the product's condition at the time of shipment.

Carrier Selection & Delivery Services

MORUXO may select or recommend a carrier based on availability, destination, price, equipment, or prior experience. Such selection or recommendation is not a guarantee of the carrier's performance.

Delivery dates and transit times provided by MORUXO or the carrier are estimates only unless expressly guaranteed in writing. MORUXO is not responsible for carrier delays, missed appointments, scheduling changes, weather delays, mechanical problems, transportation interruptions, or other events outside MORUXO's reasonable control.

Unless specifically included in writing, freight charges do not include inside delivery, assembly, installation, stair carries, elevator service, removal of packaging, storage, redelivery, special equipment, or other services beyond those specifically stated on the invoice or shipping agreement.

Shipping Insurance / Carrier Liability

Carrier liability, cargo insurance, declared-value coverage, and claim limitations vary between transportation providers. Unless MORUXO expressly agrees otherwise in writing, MORUXO does not guarantee that a shipment is insured for the full retail or replacement value of the furniture.

Buyer is responsible for requesting any additional cargo insurance or declared-value protection desired before shipment. Any additional insurance or declared-value charges may be added to the Buyer's invoice.

The existence of insurance or declared-value coverage does not guarantee that a carrier or insurer will approve or fully pay a claim.

Buyer's Inspection Obligation

The Buyer, Buyer's representative, receiving warehouse, installer, employee, building personnel, or other person accepting the shipment on Buyer's behalf must inspect the shipment immediately upon delivery.

Before signing the carrier's delivery receipt, the receiving party should inspect the packaging, crate, wrapping, and furniture for visible evidence of damage.

If damage, crushed packaging, punctures, tears, water exposure, broken crating, missing items, or other irregularities are observed, the Buyer or receiving party must clearly note the condition on the carrier's delivery receipt before signing.

Signing a delivery receipt without noting visible damage may materially affect or prevent recovery from the carrier.

Visible Damage

Visible shipping damage must be:

1. Noted on the carrier's delivery receipt before the carrier leaves whenever reasonably possible;
2. Photographed or video recorded before the furniture is moved or unpacked whenever reasonably possible;
3. Photographed during unpacking;
4. Reported to MORUXO within twenty-four (24) hours of delivery; and
5. Supported by all photographs, delivery receipts, shipping documents, packaging photographs, and other information reasonably requested for the claim.

Buyer should retain all packaging, blankets, crates, pallets, straps, wrapping, and shipping materials until the claim has been resolved or MORUXO or the carrier confirms that they may be discarded.

Concealed Damage

Any concealed shipping damage discovered after unpacking must be reported to MORUXO within forty-eight (48) hours of delivery, together with photographs or video of the furniture, damaged areas, packaging, crate, wrapping, and shipping materials.

Failure to preserve packaging or timely document and report damage may prevent or substantially reduce recovery from the carrier.

Refusal of Delivery

Buyer should not refuse an entire shipment solely because of minor or repairable damage unless instructed to do so by MORUXO or the carrier, except where the product has suffered obvious substantial damage making acceptance unreasonable.

If significant damage is discovered, Buyer should immediately contact MORUXO when reasonably possible before refusing delivery.

Unauthorized refusal of an otherwise deliverable shipment may result in storage, redelivery, return freight, handling, or other carrier charges for which Buyer may be responsible.

Freight Claims

MORUXO may, at its discretion, assist the Buyer with submitting or administering a freight claim or may authorize the Buyer to pursue the claim directly with the carrier.

Any assistance provided by MORUXO with a freight claim is a courtesy and does not constitute an admission of liability or responsibility for the shipping damage.

MORUXO does not guarantee that any freight carrier, transportation provider, or insurer will accept or pay a claim or that any claim payment will equal the purchase price, repair cost, or replacement value of the furniture.

Buyer agrees to reasonably cooperate with all claim requirements, including providing photographs, packaging, delivery documents, statements, inspections, estimates, or other requested evidence.

Failure by Buyer or Buyer's receiving representative to follow carrier claim procedures, inspect the shipment, document damage, preserve packaging, or timely report damage may limit or eliminate available recovery.

Repair or Resolution of Shipping Damage

When a carrier or insurer approves a freight claim, the method of resolution may include repair, refinishing, replacement of components, monetary settlement, replacement of the product, or another commercially reasonable remedy depending on the nature of the damage and the amount approved by the carrier or insurer.

Minor or repairable freight damage does not automatically entitle Buyer to reject the furniture, cancel the sale, receive a full refund, or demand complete replacement.

Any replacement or refund offered by MORUXO beyond amounts recovered from the carrier or insurer shall be at MORUXO's discretion except where otherwise required by applicable law.

Delivery to Third Parties

Delivery to a Buyer's employee, contractor, designer, installer, receiving warehouse, freight forwarder, building representative, family member, or other person or entity authorized to receive the shipment constitutes delivery to the Buyer.

The Buyer is responsible for ensuring that any person accepting delivery on Buyer's behalf understands and complies with these inspection and documentation requirements.

11. Environmental Conditions

Natural wood furniture performs best in climate-controlled indoor environments.

Excessive fluctuations in humidity, dryness, moisture, heat, sunlight exposure, or temperature changes may cause:

• Cracking
• Warping
• Joint movement
• Finish issues
• Expansion and contraction

Customers are encouraged to maintain stable indoor humidity conditions whenever possible.

Damage caused by environmental conditions is not considered a manufacturing defect.

12. Returns, Refunds & Cancellations

Due to the unique, handcrafted, oversized, and natural nature of MORUXO products, all sales are final.

MORUXO is under no obligation to accept returns, exchanges, cancellations, or refunds after an order has been placed, modified, shipped, delivered, picked up, or accepted by the Buyer.

Any exception shall be made solely at MORUXO's discretion and shall not create any obligation to approve future requests.

If MORUXO elects to approve a return or refund:

• Prior written authorization from MORUXO is required.
• Buyer is responsible for all return freight, shipping, insurance, packaging, and transportation costs unless otherwise agreed in writing.
• Original delivery, shipping, and handling charges are non-refundable.
• A restocking fee of up to 20% may apply.
• The product must be returned in the same condition in which it was delivered.
• Any damage occurring during return shipment remains the responsibility of the Buyer.

13. Limited Warranty Disclaimer

MORUXO products are handcrafted from natural wood and organic materials that inherently contain variation, movement, imperfections, and evolving characteristics over time.

Buyer is responsible for inspecting the product at MORUXO's location prior to pickup or at the time of delivery and installation.

By taking possession of the product, approving delivery, or allowing installation to be completed, Buyer acknowledges acceptance of the product's cosmetic condition, finish, epoxy work, wood characteristics, dimensions, and overall appearance AS-IS.

Any concerns regarding visible delivery-related damage must be reported immediately before the delivery personnel leave the premises whenever reasonably possible, or, if shipped by freight carrier, in accordance with Section 10A.

MORUXO shall not be responsible for cosmetic concerns, scratches, dents, finish wear, epoxy variation, wood variation, or other visible aesthetic characteristics reported after delivery or pickup, including claims made after the product has entered the Buyer's possession or use.

MORUXO does not provide any warranty for:

• Scratches
• Dents
• Finish wear
• Water marks
• Heat marks
• Movement of wood
• Cracking or checking
• Expansion or contraction
• Cosmetic changes
• Commercial wear and tear
• Damage from sunlight, humidity, dryness, or environmental conditions
• Improper use, handling, moving, or maintenance
• Electronics, motors, standing desk frames, or third-party accessories

Natural wood products will continue to age and change over time. These characteristics are considered normal and are not defects.

Except for major structural failures directly caused by workmanship and reported within 7 days of delivery, all products are sold AS-IS and WITHOUT WARRANTY to the maximum extent permitted by law.

For purposes of this Agreement, "major structural failure" refers solely to substantial physical failure of the primary structural integrity of the furniture rendering the product unusable for its intended purpose, including:

• Major slab separation extending substantially through the structural body of the slab
• Failure of major load-bearing joints or supports
• Structural collapse under normal intended use
• Major failure of welded structural components

All other cosmetic, environmental, finish-related, epoxy-related, electronic, dimensional, leveling, movement-related, or naturally occurring characteristics described elsewhere in this Agreement are specifically excluded from warranty coverage.

14. Limitation of Liability

To the maximum extent permitted by law, MORUXO shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use any product.

MORUXO's maximum liability shall never exceed the original purchase price of the product.

Under no circumstances shall MORUXO be responsible for hotel costs, project delays, installation delays, contractor costs, lost profits, business interruption, substitute furniture, rental expenses, labor charges, or any other consequential or incidental damages arising from shipment delays, freight damage, natural wood characteristics, or product performance.

15. Force Majeure

MORUXO shall not be held responsible for delays or failure to perform resulting from causes beyond its reasonable control, including but not limited to material shortages, shipping delays, labor shortages, natural disasters, weather events, power outages, supplier delays, transportation interruptions, or acts of God.

16. Taxes

Any applicable sales tax, use tax, delivery tax, import tax, or governmental fees associated with the sale, transportation, or installation of products shall be the responsibility of the Buyer unless otherwise stated in writing.

17. Waiver

Failure by MORUXO to enforce any provision of these Terms shall not be considered a waiver of any future rights or enforcement of these Terms.

18. Severability

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18A. Attorney's Fees

In any legal action or proceeding arising out of these Terms or the purchase of MORUXO products, the prevailing party shall be entitled to recover its reasonable attorney's fees, court costs, and expenses to the extent permitted by applicable law.

19. Governing Law

These Terms & Conditions shall be governed by and interpreted under the laws of the State of Texas.

20. Dispute Resolution

The parties agree to attempt in good faith to resolve any dispute informally prior to initiating legal action.

Any legal claim arising from the purchase or use of MORUXO products shall be brought exclusively in the State of Texas.

21. Acceptance of Terms

By any of the following actions, the Buyer acknowledges that they have read, understood, and agreed to these Terms & Conditions of Sale in full:

• Submitting partial payment
• Submitting full payment
• Paying a deposit
• Approving an invoice
• Approving drawings, layouts, or modifications
• Scheduling delivery or pickup
• Accepting delivery
• Taking possession of any product

These Terms & Conditions apply whether or not the Buyer physically signs a separate agreement.

For purchases completed remotely, including online sales, email transactions, text messaging, invoices, electronic payment links, or telephone orders, the Buyer acknowledges that payment, invoice approval, or acceptance of delivery constitutes agreement to these Terms & Conditions.
